Acceptance of these terms
Welcome to the website of The Keystone Mental Wellness Project ("KMWP," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of keystonementalwellnessproject.com and its content (the "site"). By accessing or using the site, you agree to be bound by these Terms, our Privacy Policy, and our Disclaimer, which are incorporated here by reference. If you do not agree, please do not use the site.
Educational use only
Everything on this site, including our pages, articles, program and workshop descriptions, and resources, is provided for general education and information. It is meant to help students, parents, and educators learn about mental wellness. It is not medical, psychological, or professional advice, and it is not a substitute for care from a qualified professional. Please do not use anything here to diagnose or treat a health condition. For guidance about your situation, talk with a licensed provider. Our Disclaimer explains this in more detail.
Not a crisis or emergency service
KMWP is not a crisis or emergency service. Our inboxes and forms are not monitored around the clock. If you or someone you know is in crisis or in immediate danger, call or text 988 (the Suicide and Crisis Lifeline), text HOME to 741741, or call 911. You can find more on our Get Help page.
Eligibility and minors
The site is intended for a general audience and for students who are high school age, generally 14 and older. If you are under 18, you may use the site only with the involvement and permission of a parent or guardian, and you should review these Terms together. We collect information from minors only as described in our Privacy Policy, and we request verifiable parental or guardian consent before enrolling a volunteer under 18. By using the site, you represent that the information you provide is accurate and that you have the authority to agree to these Terms, or that a parent or guardian has agreed on your behalf.
Acceptable use
When you use this site, you agree that you will not:
- Use it for any unlawful purpose or to harm others.
- Submit false information, spam, or content that is abusive, harassing, hateful, or threatening through our forms.
- Attempt to disrupt, overload, hack, or gain unauthorized access to the site or its systems.
- Copy, scrape, or republish our content for commercial purposes without our permission. You are welcome to share links to our pages.
- Impersonate KMWP, a team member, or anyone else, or misrepresent your connection to us.
We may limit or block access if these Terms are misused. Please use our forms respectfully. Real people, many of them students, read what you send.
Intellectual property
The KMWP name, logo, and the original text, graphics, and other content on this site are owned by KMWP or its licensors and are protected by United States and international copyright, trademark, and other laws. We grant you a limited, personal, revocable, nonexclusive license to view and share our pages for personal, noncommercial use. You may not copy, reproduce, distribute, modify, or create derivative works from our content for commercial purposes without our prior written permission. You are welcome to link to our pages. All rights not expressly granted are reserved.
Third party links
This site links to outside resources, including crisis lines such as the 988 Suicide and Crisis Lifeline, the Crisis Text Line, and the Trevor Project, as well as other organizations. We provide these third party links as a convenience to help you reach help quickly. We do not control those sites and services, we are not responsible for their content or practices, and including a link does not mean we endorse everything they do. When you follow a link, that organization's own terms and privacy practices apply. We strongly encourage you to use these crisis resources whenever you need them.
Disclaimer of warranties
The site and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, KMWP disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, and any warranties arising from a course of dealing or usage of trade. We do not warrant that the site will be uninterrupted, timely, secure, or free of errors or harmful components, or that the content is accurate, complete, reliable, current, or suitable for your circumstances. Any reliance you place on the site or its content is at your own risk.
Limitation of liability
To the fullest extent permitted by applicable law, KMWP and its founders, team members, volunteers, advisors, and partners (the "KMWP parties") will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or your inability to use, the site or its content, whether based in contract, tort, negligence, strict liability, or any other legal theory, even if a KMWP party has been advised of the possibility of such damages.
To the fullest extent permitted by law, the total liability of the KMWP parties for all claims relating to the site will not exceed the greater of the total amount you paid us, if any, in the twelve months before the claim, or one hundred dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of the above may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless the KMWP parties from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the site, your violation of these Terms, or your violation of any rights of another person or any applicable law. If you are a parent or guardian agreeing on behalf of a minor, you accept this responsibility for that minor's use of the site.
Governing law and disputes
These Terms, and any dispute arising out of or relating to them or to the site, are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules. Before filing any claim, you agree to first contact us at info@keystonementalwellnessproject.com and to try in good faith to resolve the matter informally. If a dispute cannot be resolved that way, you agree that it will be brought exclusively in the state or federal courts located in Lancaster County, Pennsylvania, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, any claim relating to the site must be filed within one year after it arises, or it is permanently barred.
Changes to these terms
We may update these Terms from time to time. When we do, we will change the "last updated" date above. Continuing to use the site after a change means you accept the updated Terms.
General terms
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent, and we may assign them to a successor. These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and KMWP regarding the site, and they replace any prior understandings on that subject.
